1. Acceptance of Terms

By accessing, browsing, registering on, or otherwise using hlumi.com (the “Website” or “Platform”), you agree to be legally bound by these Terms and Conditions (“Terms”), our Privacy Policy, our Cookie Policy, and our Affiliate Disclosure, all of which are incorporated herein by reference.

These Terms constitute a legally binding agreement between you (“User”) and Search Media LLC, the operator of hlumi.com (“we,” “us,” or “our”). If you do not agree with any part of these Terms, you must immediately stop using the Platform.

2. Changes to Terms and Services

3. The Platform and Services

hlumi.com is a free, publicly accessible video sharing and streaming platform operated by Search Media LLC. The Platform allows users to:

• Upload, publish, and share video content across a range of categories
• Create and manage personal channel pages with custom branding
• Watch, like, comment on, and share videos uploaded by other creators
• Subscribe to channels and receive updates on new content
• Discover content through search, trending feeds, and category browsing
• Stream live video to audiences via RTMP-based live streaming
• Embed hlumi.com video players on external websites

hlumi.com is supported by advertising revenue including Google AdSense display ads, Google AdSense for Video (IMA SDK), Google AdSense for Search / RSOC, and Auto Ads (anchor, vignette, side rail). The Platform is provided free of charge on the basis of this advertising revenue. By using the Platform, you agree to the display of advertisements as described in Section 9 of these Terms.

4. Eligibility

By using hlumi.com, you represent and warrant that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction, whichever is higher)
• If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you have obtained consent from a parent or legal guardian
• You have the legal capacity to enter into a binding agreement under applicable law
• Your use of the Platform does not violate any applicable law, regulation, or third-party right

We reserve the right to refuse access to, suspend, or permanently ban any user who violates these Terms, provides false information, or engages in conduct harmful to the Platform, other users, or third parties — at our sole discretion and without prior notice.

5. User Accounts & Registration

Certain features of hlumi.com — including uploading videos, creating a channel, liking content, and commenting — require you to register for a user account. When registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Keep your account credentials (username and password) confidential
• Accept full responsibility for all activity that occurs under your account
• Notify us immediately at [email protected] if you suspect unauthorised access to your account

You may not share your account credentials with any other person or allow third parties to access your account. We will not be liable for any loss or damage arising from your failure to maintain the security of your account.

We reserve the right to suspend or terminate any account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

6. User-Generated Content

hlumi.com is a user-generated content platform. By uploading, posting, or submitting any video, comment, description, thumbnail, or other content (“User Content”) to hlumi.com, you:

6.1 Grant of Licence

Grant hlumi.com and Search Media LLC a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, transcode, reproduce, display, distribute, and make available your User Content on the Platform and via the embed player for the purpose of operating the service.

6.2 Representations & Warranties

Represent and warrant that:

• You own the User Content or have all necessary rights, licences, and permissions to upload and share it
• Your User Content does not infringe any third-party copyright, trademark, privacy right, or other intellectual property right
• Your User Content complies with these Terms and all applicable laws
• Your User Content does not contain any material that is unlawful, harmful, defamatory, obscene, hateful, or otherwise objectionable

6.3 Content Moderation

We reserve the right — but assume no obligation — to review, moderate, edit, remove, or restrict access to any User Content at any time and without notice if we determine, in our sole discretion, that it violates these Terms, our content policies, or applicable law. You acknowledge that we operate a community flagging system under which content receiving multiple flags may be subject to review and removal.

6.4 Prohibited Content

You must not upload, post, or share any content that:

• Infringes any third-party copyright, trademark, or other intellectual property right
• Is pornographic, sexually explicit, or adult in nature (unless expressly permitted)
• Depicts graphic violence, gore, or promotes self-harm
• Promotes hatred, discrimination, or violence against any individual or group
• Contains misinformation, disinformation, or deliberate falsehoods likely to cause harm
• Violates any individual’s privacy, including non-consensual intimate imagery
• Promotes or facilitates illegal activity of any kind
• Is spam, artificially inflates engagement metrics, or constitutes coordinated inauthentic behaviour

7. Permitted Use & User Conduct

hlumi.com is provided for lawful, personal, and non-commercial use only. You agree not to use the Platform to:

• Violate any applicable local, national, or international law or regulation
• Reproduce, resell, or commercially exploit any content without prior written permission
• Scrape, crawl, spider, or extract content or data via automated tools or bots
• Transmit spam, unsolicited promotional materials, or commercial solicitations
• Impersonate any person, entity, or organisation, or misrepresent your affiliation
• Post false, defamatory, misleading, or copyright-infringing content
• Attempt to gain unauthorised access to any part of the Platform, server, or database
• Interfere with, disrupt, or degrade the performance or security of the Platform
• Artificially inflate view counts, likes, comments, or subscriber counts through any means
• Use the Platform in any manner that could damage, disable, overburden, or impair the service

8. Intellectual Property & Copyright

All proprietary content on hlumi.com — including the platform design, logo, branding, layout, interface elements, software, and editorial content produced by Search Media LLC — is owned by or licensed to Search Media LLC and is protected by applicable copyright, trademark, and intellectual property laws.

User-uploaded videos remain the intellectual property of the respective creator or rights holder. hlumi.com claims no ownership over User Content beyond the limited licence granted in Section 6.1 of these Terms.

9. Advertising Disclosure

hlumi.com displays third-party advertisements to support the free operation of the Platform. By using hlumi.com, you acknowledge and agree that the following ad types may be displayed:

• (a) Display and native ads served by Google AdSense — including responsive banner ads, in-article, in-feed, multiplex, anchor, side rail, and vignette ad units
• (b) Search-based ads via Google AdSense for Search / RSOC (AFS) through Google’s Search Partner Network — contextual search suggestion units that display paid results when clicked
• (c) Video advertisements via Google AdSense for Video (IMA SDK) — including pre-roll, mid-roll, post-roll, non-linear overlay, and companion ads served inside the hlumi.com video player
• (d) Native advertising and content recommendation widgets served by third-party networks, where applicable

Where search results carry an “Aff” or “Affiliate” label, hlumi.com or its authorised feed provider may receive financial compensation related to that result.

10. Third-Party Content and Links

hlumi.com may contain links to external websites, embedded third-party content, or references to external services. These links and references are provided for informational and convenience purposes only and do not constitute an endorsement, recommendation, or approval by hlumi.com or Search Media LLC of those sites, their content, or their operators.

We have no control over the content, privacy practices, availability, or accuracy of any third-party website or service. Your access to and use of any third-party site is entirely at your own risk and subject to that site’s own terms and privacy policy. We shall not be liable for any loss, damage, or harm arising from your reliance on or use of third-party content or services.

Third-party content linked from or embedded on hlumi.com may contain material that some users find objectionable. You acknowledge and accept this risk by using the Platform.

11. Disclaimer of Warranties

• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the Platform will be uninterrupted, timely, secure, or error-free
• Any warranty that defects in the Platform will be corrected
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of any content on the Platform
• Any warranty that the Platform or its servers are free of viruses, malware, or harmful components
• Any warranty that results obtained from use of the Platform will be accurate or reliable

You use hlumi.com entirely at your own risk. No oral or written information or advice given by hlumi.com or any of its personnel shall create any warranty not expressly stated in these Terms.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Search Media LLC, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of revenue, loss of profits, loss of data, loss of goodwill, or service interruption — arising out of or in connection with your use of, or inability to use, hlumi.com or any content found thereon.

This limitation of liability applies regardless of whether such damages are based on warranty, contract, tort, statute, or any other legal theory, and whether or not Search Media LLC has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages — in such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Termination & Suspension

We reserve the right to suspend, restrict, or permanently terminate your access to hlumi.com — including your user account and any content you have uploaded — at any time and without prior notice, for any reason including but not limited to:

• Violation of any provision of these Terms and Conditions
• Upload of content that violates our content policies or applicable law
• Engagement in fraudulent, abusive, or harmful conduct on the Platform
• Receipt of valid DMCA takedown requests relating to your content
• Any other conduct that we determine, at our sole discretion, to be harmful to the Platform, other users, or third parties

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property provisions, disclaimers, limitations of liability, and governing law — shall survive.

14. Privacy

Your use of hlumi.com is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in those policies. We encourage you to read them carefully.

15. DMCA & Copyright Infringement

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute arising out of or in connection with your use of hlumi.com shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions.

You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Bernalillo County, New Mexico, USA for the resolution of any disputes arising under or relating to these Terms or your use of the Platform.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
